The Internet portal www.medicovada.com is operated by Medicoveda Healthcare Solutions (formerly known as Medicoveda Healthcare Solutions), a company duly incorporated under the provisions of the Companies Act, 2013 (hereinafter referred to as “MedicoVada” or “we” or “our” or “us” or the “Company”), having its registered office at Rania Kanpur Dehat, 209304. The term “Website” refers to both the domain name and the mobile application.

2. The following terms and conditions govern your access to or use of the Website, transactions on the Website and your use of remotely hosted or managed services (as defined below) through the Website, including applicable policies, which are incorporated herein by reference. These Terms of Use are a legally binding contract between you (hereinafter referred to as “you” or “your” or “user“) and Medicoveda.

3. By accessing, browsing or transacting on the Website or using any of the Services, you agree to be governed by these Terms of Use. Further, by accepting these Terms of Use, you accept and agree to be bound by our policies, Privacy Policy (as set out in Part B below) and such other rules, guidelines, policies, terms and conditions as are relevant under the applicable law in India and other jurisdictions for the purposes of accessing, browsing or transacting on the Website or availing any of the Services, and such rules, guidelines, policies, conditions. However, if you leave the Website to visit a third party website, you may be subject to different terms of use and privacy policies described on that website. In such cases, your use of the Website will be governed by the terms of use and privacy policy applicable to that website.

The Website is a platform that facilitates (i) online purchase of pharmaceutical products sold by various third party pharmacies (“Third Party Pharmacies“) and the Company; (ii) diagnostic services offered by various third party diagnostic centers (“Third Party Labs“); (iii) online medical consultation services/second opinions offered by third party independent doctors (“Medical Experts“); and (iv) online advertisements from various sponsors and “Third Party Service Providers” which include third party pharmacies, labs, medical experts and third party advertisers. In addition, the Website serves as an information platform, providing users with information related to health and wellness (the “Information Services”).

5. The agreement between you, the third party service providers and us is governed by these Terms of Use. Only those natural persons use the Services who consent to use the Website by obtaining registration under our prescribed process. (These are referred to as “you,” “your,” “yourself” or “user“, including those who use the Website only as visitors). The Services are available to you in various ways, including discount coupons and vouchers to be used for goods or services sold by the third party service providers. To facilitate the relationship between you and the third party service providers through the Website, Medicoveda sends you promotional materials (such as emails, notifications and messages).

6. You agree and acknowledge that this Website serves as a platform where you and third party service providers connect and communicate for your business transactions. Medicoveda is not a party to any transaction and does not control such transactions in any manner, except as specified in these Terms of Use.

7. Medicovada reserves the right to modify or alter these Terms of Use, Website policies or guidelines, including the Privacy Policy, at any time in its sole discretion. Any modifications or changes will be effective immediately upon posting on the Website, and you waive any right you may have to receive prior notice of such changes. However, we will provide you with notice of such changes at least once a year. Continued use of the Website will signify your acceptance of these modifications or changes. Therefore, we recommend that you review these Terms of Use and related policies from time to time to ensure a clear understanding of the terms and conditions governing use of the website.

8. As a mandatory condition of use of the website, the User must be 18 (eighteen) years of age or older. By entering the Website or accepting these Terms of Use, the User warrants and warrants to Medicoveda that he/she is 18 (eighteen) years of age or older and has the full authority and capacity to use the Website, agree to these Terms and abide by them.

9. These Terms of Use are published under and governed by applicable provisions of Indian laws, including but not limited to the following:

  • The Indian Contract Act, 1872 (“Contract Act”);
  • The Information Technology Act, 2000 (“IT Act”), along with its related rules, regulations, guidelines and clarifications, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011, and the Information Technology (Intermediaries Guidelines) Rules, 2011 (“IG Guidelines”);
  • The Drugs and Cosmetics Act, 1940 (“Drugs Act”), read in conjunction with the Drugs and Cosmetics Rules, 1945 (“Drugs Rules”);
  • The Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 (“Drugs and Magic Act”);
  • The Indian Medical Council Act, 1956, along with the Indian Medical Council Rules, 1957; The Pharmacy Act, 1948 (“Pharmacy Act”); and The Consumer Protection Act, 2019, including the Consumer Protection (E-Commerce) Rules, 2020.

10. Medicoveda permits you to view and access the content of the Website only for the purpose of using the Services under these Terms. This includes visiting, using, ordering, receiving, receiving deliveries and communicating on the Website. The content of the Website includes information, text, graphics, images, logos, button icons, software code, design and compilation and arrangement of content. It also includes content from third party service providers (“Third Party Content”) and in-house content provided by Medicoveda (“MEDICOVEDA Content”), including text, audio, video, photos, illustrations, graphics and other visuals.

11. Medicoveda Content is the property of the Company and is protected by copyright, trademark and other relevant laws. You may not modify, reproduce, display, publicly perform, distribute or otherwise use the Content for any commercial, public or personal gain. Compliance with these Terms will grant you a personal, limited, non-transferable and non-exclusive privilege to access and transact with the Website.

12. These Terms of Use are an electronic record under the IT Act and applicable laws thereunder, as applicable and amended from time to time. This electronic record is created by computer systems and does not require any physical or digital signatures.
